General Terms and Conditions (“GTC”)

1. Applicability of These Terms

These General Terms and Conditions (“GTC”) set forth the rules governing the provision of services by One Blank Map sp. z o.o., a Limited Liability Company registered in Warsaw, Poland, entered in the National Court Register conducted by the District Court for the Capital City of Warsaw in Warsaw (XII Division), under KRS number [0001090186], NIP: [5252993730], REGON: [527883827], with a share capital of 5000 PLN.

The GTC defines the rights and obligations between One Blank Map sp. z o.o. (hereinafter referred to as the “Organiser”) and any individual, group of individuals, families or entity (hereinafter the “Participant”) who book and/or participate and/or engages in activities or services offered by the Organiser, including but not limited to recreational activities, tours, events, gear rental, and logistical support for outdoor activities.

2. Booking and Formation of Contract

Bookings can be made at any time directly with the Organiser or via an authorized sales partner. Reservations may be submitted in writing, electronically, by phone, or in person. Availability is limited and not guaranteed, only a booking confirmation is the sole proof and guarantee of the availability of the service.

By making a reservation and/or participating and/or using the services of the Organiser, the Participant acknowledges and accepts these General Terms and Conditions.

Participants are responsible for ensuring the accuracy of the personal information provided at the time of booking. It is also their responsibility to verify the correctness of all details in the confirmation or invoice. Any discrepancies must be reported to the Organiser without delay. The Participant shall bear any additional costs resulting from the failure to report such discrepancies in a timely manner.

The Organiser shall not be liable for any loss, damage, injury, or inconvenience resulting from incorrect or incomplete information provided by the Participant who is making the booking on behalf of other Participants regarding the suitability or eligibility of any Participant.

The Participant acknowledges that upon the confirmation of booking, the Organiser begins the work and arrangements necessary for the provision of the service.

There will be no refund in case of the Participant’s failure to meet the required conditions, inability to Participate, late arrival, no-show, voluntary withdrawal, or provision of incorrect or incomplete information by the Participant making the booking.

3. Subject of the Agreement

The subject of the agreement are the recreational activities, guided tours, or service as described and offered by the Organiser. The Organiser will act with due diligence to deliver the service in accordance with the description provided at the time of booking.

The Participant agrees to pay the full amount specified in the booking confirmation or as otherwise agreed in writing.

The Organiser reserves the right to not approve booking requests from a potential Participant without justifying the reasons for the refusal.

Any optional or additional services requested by the Participant must be arranged with the Organiser in advance and may incur extra charges, which will be borne by the Participant.

4. Prices

The Organiser accepts payments in Polish zloty (PLN) and in some occasions, in Euro. All prices are stated per person and include applicable VAT. Unless indicated otherwise, prices are listed in Polish zloty (PLN) or Euro and are subject to change at any time prior to booking confirmation. Prices provided in other foreign currencies are for reference only and do not constitute a binding offer.

Prices for the services do not include bank transfer fees or any other additional charges. The amount presented to the Participant is the net amount that must be credited to the Organiser’s bank account; any transfer fees or other charges must be covered by the Participant.

The price of the service is determined according to the prices and taxes known to the Organiser on the day the price quote is provided. If there are changes in the service rates that are not under the control of the Organiser the price of the service will change and the increase will apply to the Participant.

The quoted price covers only the specific services listed in the “price includes” section . It does not include transportation to or from the starting and finishing point of the activity, personal expenses (such as meals, drinks, phone calls, tips, etc.), or any other services that were not explicitly stated in writing by the Organiser.

5. Terms of Payment

5.1 General Payment Conditions

The total price for the booked service must be paid in advance, no later than before the commencement of the activity, unless otherwise agreed individually in writing. Bookings are confirmed only after full payment is received, unless explicitly stated otherwise in writing in the booking terms.

The Organiser accepts various forms of payment, including electronic payments, bank transfers, and other methods indicated during the booking process. The date of payment is deemed to be the date the funds are credited to the Organiser’s bank account or confirmed by the Organiser’s payment operator.

Payments for services may be made in cash, subject to prior agreement with the Organiser and in accordance with applicable legal regulations. The Participant is responsible for ensuring that any cash payments are made directly to an authorized representative of the Organiser and that a receipt is obtained as proof of payment.

In the event of non-payment by the due date, the Organiser reserves the right to cancel the booking or withhold the provision of the service without liability for any resulting costs or damages to the Participant. If a late payment by the Participant results in any damage and additional costs to the Organiser, the Participant will be required to cover those expenses prior to the service. If the Participant refuses to pay these costs, the Organiser reserves the right to withhold the service.

5.2 Deposits and Special Payment Terms

For certain services, particularly tailor-made, private and group bookings, the Organiser may require a non-refundable deposit at the time of booking. If a deposit is requested, the balance must be paid by the date specified in the payment request.

6. General Cancellation and Fees Policy

6.1 Cancelation of day tours and/or activities operated by the Organiser

These cancellation policies are not applicable for multi day tours or activities.
The following are the cancellation fees applicable in the event of a cancellation initiated by the Participant:

– Up to 46 days before the service date, a fee of 15% is nonrefundable.
– Between 45 to 15 days before the service date 50% of the price will be charged.
– During 14 days before the service date the full price will be charged.

Certain activities may be subject to separate and specific cancellation terms, conditions, and fee structures which will be mentioned at the service page.

6.2 Cancelation of multi days tours and activities

These cancellation policies are not applicable for day tours or activities.
The following are the cancellation fees applicable in the event of a cancellation initiated by the Participant:

– Up to 80 days before the service date 35% of the price will be charged.
– Between 79 to 46 days before the service date 65% of the price will be charged.
– Between 45 to 31 days before the service date 85% of the price will be charged.
– During 30 days before the service date the full price will be charged.

Certain activities may be subject to separate and specific cancellation terms, conditions, and fee structures which will be mentioned at the service page.

6.3 General Cancellation Terms

Group and/or Private bookings must be confirmed in writing with the Organiser.

Participants may cancel or request changes before the start of the service, in writing.
In such cases, refunds will be issued according to the cancellation policy, and no additional costs apply. Any previously issued booking materials must be returned.

The cancellation becomes effective upon receipt of the notice by the Organiser or an authorized sales partner.

6.4 Partial Cancellations of Group Bookings

Partial refunds are not possible, as the price is calculated based on the total number of participants at the time of booking. In some occasions partial cancellation will be possible with recalculation of the price per person.

6.5 Cancellation Insurance

Participants are responsible for obtaining cancellation insurance. It is strongly recommended.

6.6 Program Changes by the Participant

In case of delayed arrival, early departure, or rescheduling by the Participant, no refunds will be issued. Any additional costs incurred are borne by the Participant. If the Participant postpones the activity, cancellation charges as above may apply.

7. Cancellation or Program Changes by the Organiser

7.1 Minimum Participant Requirements

Certain activities and tours require a minimum number of participants. If this minimum is not reached, the Organiser reserves the right to combine groups, withdraw from the agreement, or cancel the activity or tour at short notice. In such cases, the Organiser will attempt to offer alternative arrangements. If no suitable substitute can be provided, any payments made will be refunded, minus charges for services already rendered. Additional compensation claims are excluded.

7.2 Non-compliance or Inability to Participate

The Organiser reserves the right to cancel the activity, tour or service at any time if a Participant’s behavior, condition, or failure to follow instructions jeopardizes the execution of the service. The Organiser may cancel or modify the service accordingly. In these cases, no refund is due.

7.3 Force Majeure

If an activity or part of it is canceled or interrupted due to force majeure (e.g., natural disasters, official restrictions, strike, non-operation of transport services, or unsafe weather conditions but not limited to), the Organiser may do so without obligation to compensate the Participant. Participants will be notified as soon as possible. The Organiser may also relocate the activity or modify the program.

7.4 Program Adjustments for Outdoor Activities

The Organiser reserves the right to adjust program details such as meeting points, routes, or activity locations due to weather, safety, or logistical considerations.

8. Conditions of Participation and Participant Obligations

8.1 Requirements

All Participants must be in good physical and mental condition to take part in the activities and tours, or to use the service of the Organiser.

The Organiser does not have the medical means, medical qualifications and medical information to determine the suitability and fitness of a Participant for a tour, activity or service. Any decision on this matter is and will be the sole and absolute responsibility of the Participant and their doctors. The Organiser will not be responsible for the medical condition of the traveler.

It is the Participant’s full and absolute responsibility to inform their attending physician regarding the trip or the planned activity and ensure in advance prior to the booking that they are medically fit to participate and their health condition permits them to take part in the trip, activity or use of the service.
Participants must not be under the influence of alcohol, drugs, or any substances affecting mental state.

Participants must have appropriate clothing and gear that are suitable for the activities and weather conditions.

If a Participant must end their participation early due to unfitness or inappropriate personal equipment, no refunds will be granted.

8.2 Specific Participation Criteria

Certain activities may impose participation criteria such as weight limits, age restrictions, or required swimming ability. These criteria are detailed in the activity descriptions and are binding. Failure to meet them or to comply with the instructions of the Organiser may result in exclusion from the activity without a right to refund.

8.3 Compliance with Instructions

Participants must meet all participation criteria and strictly follow all instructions provided by the Organiser and its representatives. Non-compliance may result in immediate exclusion from the activity or event. If exclusion occurs before the start, the cancellation terms under Section 6 apply. If after the activity has started, no refund will be issued.

8.4 Age Requirements

Participants under the age of 18 must have a parent and/or legal guardian present to participate. Some activities may require participants to meet a minimum age or height or weight, which will be specified in the activity description.

9. Special requirements for self-guided activities, programs, and tours.

Self guided activities, programs and tours are a service for travelers that can travel, navigate and be outdoors independently and complete alone the intended route. This service is by no means guided.

The participants acknowledge and accept that the Organiser provides only the booking support for the Participant’s independent trip.

Participant who is interested and plans to book the service of self guided activities, programs and tours must know how to travel independently, navigate, and have the skills for traveling alone. The Organiser does not have the means, qualifications nor information to determine the suitability and fitness of participants for a trip or relevant activity. Any decision on this matter is and will be the sole and absolute responsibility of the Participants.

Before booking the service, the Participants must know if they are capable of traveling into the designated area and they do so at their own responsibility.

Some of the routes pass through wild areas and are remote from settlement centers, the traveler must be aware of the search and rescue restrictions and complications in the trip areas and prepare accordingly.

Before booking the service, the Participants must be confident of their capacity to accomplish the intended travel outdoors independently.

10. Requirements for bike tours.

The Organiser is not liable for any damage of any kind, whether physical or mental, or property damage – incurred between participants involving third parties as a result of using and riding the bicycle. Furthermore, the Organiser is not responsible for bodily or mental injury, or property damage, including but not limited to those arising from traffic accident during the Participant’s trip or from delays and malfunctions resulting from changes in traffic arrangements.

Participant who are interested and plans to join any cycling activities, programs and tours, guided and/or self guided must know how to cycle, how to use bicycles with gear.
Cycling activities include cycling on different terrain such as but no limited to roads with cars, gravel, offroads, pedestrian, bikelains and other type of roads.

The Participant must be confident riding bicycle, and familiar with safety and laws of cycling in urban and wild environments. The Organiser does not possess the means, qualifications or information to determine the suitability or fitness of any participants for a trip or related activity. Any decision on this matter is and will be the sole and absolute responsibility of the participants.

Before leaving the point of service, each participant is required to check that all mechanical systems of the equipment (including brakes and other crucial parts of rented equipment) are functioning properly. Any malfunction or defect noticed before or during the activity must be immediately reported to the staff. Failure to do so may result in the Participant being held responsible for any resulting damage or safety incidents.

The participant must use the bicycle and all equipment in a responsible manner and exercise caution and awareness at all times while cycling. It is the participant’s responsibility to use the roads responsibly, to remain attentive throughout the activity, and to take all necessary precautions to prevent harm to themselves, other road users, the bicycle, equipment, third-party property, etc.

The use of mobile phones or any other devices or items that may distract the participant during cycling activities is strictly prohibited. The consumption of alcohol or any intoxicating substances before or during the activity is also strictly forbidden. Violation of these rules may result in immediate removal from the activity or tour without any refund or the possibility to reschedule.

11. Equipment Rental – Liability Waiver and Deposit

Rental of equipment is subject to the Participant signing a liability waiver and paying a deposit before the equipment is issued.

A deposit is required for each rental. The deposit may be paid in cash or by credit card, as agreed with the Organiser at the time of rental, and is documented with a receipt. The deposit is returnable after the equipment is returned and inspected by the Organiser to confirm that it is in proper and undamaged condition, accounting for normal wear and tear.

If, upon inspection, the Organiser identifies any damage, loss, or missing items, the Participant will be informed of the nature and amount of the deductions.

If the deposit does not cover the full cost of the damage or loss, the Participant is obliged to pay the outstanding amount upon request. The amount due will be calculated based on the current market value of the used equipment plus an applicable service fee.

The relevant costs will be deducted from the deposit, and any remaining balance will be returned to the Participant up to 30 days from the date the equipment is returned and all claims are settled.

12. Bike Rental – Liability, Maintenance and Deposit

​Wherever used herein, the term “equipment” shall include any equipment rented from The Organiser.  The Organiser, its agents, servants, and employees shall not be responsible for personal injuries or property damage, loss or delay incurred by any person arising out of the act of negligence of any direct or supplemental carrier or other person rendering any of the services or products being offered in these rentals; nor shall The Organiser be responsible for any injuries, death, damage, loss or delay in any means of transportation or by reasons of any event beyond the actual control of The Organiser, or of any agent or supplier, or due to force majeure.

Participants follow any suggested itinerary at their own risk and agree not to hold The Organiser responsible for injury or death resulting from accidents. We strongly recommend the use of approved helmets whenever mounted on a bicycle. 

The bicycles provided for use are in satisfactory operating condition and Participants agree to use them at their own risk or call deficiencies to the attention of a company representative. ​Individual bike specifications are subject to change based on availability of replacement components.

Instruction in the use, assembly and maintenance of bicycles will not be provided and Participants affirm that they are competent and familiar with the use of a multi-speed bicycle.

Maintenance, Tuning and Responsibility

The Organiser’s bicycles are professionally serviced before every rental to ensure they are in excellent working condition.

However, during the rental period, minor tuning or routine maintenance may be required as part of normal use. Such maintenance is the responsibility of the Participant and will be carried out at their own expense. 

It is the Participant’s responsibility to have basic bicycle maintenance skills when using the Organiser’s rented gear. If you are undertaking an unassisted bicycle tour we strongly recommend that you have some basic bicycle maintenance knowledge.  A list of the closest bike shops can be provided on request.

The Organiser will cover the cost of damages caused by equipment failures beyond the Participant’s control, such as damage appearing before the Participant leaves the office, during transport conducted by the Organiser or failure of worn parts. Any such deficiencies must be reported to the Organiser at the time of receiving the equipment. 

To be eligible for a refund on parts or service, the Participant must provide via email a clear photo of the damaged or worn part.

The Participant hereby acknowledges and agrees that any malfunction, defect, or damage to the rented equipment that occurs or is discovered subsequent to the equipment’s departure from the Organiser’s premises must be reported to the Organiser immediately upon discovery. Failure to notify the Organiser promptly may result in the Participant being held fully liable for any resultant damage or additional repair costs.

The Participant shall bear all costs associated with the repair of any malfunction or damage arising during the rental period, except for those costs attributable solely to normal wear and tear consistent with proper use of the equipment. The determination of what constitutes normal wear and tear shall be at the sole discretion of the Organiser.

The Replacement Price List outlines the costs for lost, stolen, or damaged gear beyond normal wear and tear. These charges reflect the current market value or reasonable repair costs for the affected items. Please inspect all equipment upon receipt and notify the Organiser immediately of any pre-existing damage. 

Treat the gear as you would your own, we will always aim to find the most cost-effective solution should an issue arise.

Rental of equipment is conditional upon the Participant signing a liability waiver and paying a security deposit before the equipment is issued. A separate deposit is required for each rental. This deposit may be paid in cash or by credit card, as agreed with the Organiser at the time of rental, and will be recorded with a receipt.

The deposit will be refunded once the equipment is returned and inspected, provided it is in proper and undamaged condition, accounting for normal wear and tear. If any damage, loss, or missing items are identified, the Participant will be informed of the issue and the corresponding deduction. If the cost is not listed in the Replacement Price List, it will be calculated based on the current market value plus any applicable service fee.

If the deposit does not cover the full amount owed, the Participant must pay the remaining balance immediately upon request. Refusal to pay may result in legal action to recover the loss. Any remaining balance of the deposit will be returned within 30 days after the equipment is returned and all claims are settled.

DELIVERY AND COLLECTION

Delivery and collection service is subject to approval by the Organiser at delivery and collection location.

Participants are responsible for ensuring that management at their accommodation is agreeable to provide safe storage for bikes pending the Participants arrival. 

RESPONSIBILITY FOR DAMAGE OR LOSS

Participant agrees he/she will return the equipment in the same good condition as when received, ordinary wear and tear accepted, and to repair and replace lost or stolen, damaged or broken bicycles or parts or to reimburse The Organiser for said equipment. Therefore regardless of the party at fault, the Participant understands and agrees to be responsible for the theft or damage to said equipment.

SUBLEASING PROHIBITED

Participant understands and agrees that any subleasing of rental equipment is prohibited and that any such sublease shall immediately cause termination and cancellation of this contract. The Bike is intended solely as a means of transportation along designated marked trails. The Participant agrees to operate the bike in a safe, responsible, and courteous manner at all times to ensure their own safety, the safety of others, and the preservation of the Bike. The use of the Bike for stunts, tricks, jumps, or any reckless behavior is strictly prohibited and may result in immediate termination of the rental and/or fines.

Participant LIABILITY

Participant shall assume liability for any and all damage or loss of and to personal property, accident / injury to other persons related to said rental equipment.

PERSONAL INSURANCE

We strongly recommend that you always carry a personal travel insurance policy.

LATE RETURN FEE

An additional day’s rental fee will be charged for each day the Participant keeps equipment after the return date specified on this contract.

Rates for additional days:

€50 per day, per bike 

All equipment must be returned directly to The Organiser.

13. Liability

The Organiser is liable only for damages arising from willful misconduct or gross negligence. It may employ auxiliary persons or third-party providers to deliver the services. If services are lawfully outsourced, the Organiser is not liable for acts or omissions of the third parties to the extent permitted by law.

The Organiser is not liable for damages resulting from actions or omissions of the activity leader that are unrelated to the agreed services, from third-party conduct, force majeure, official regulations, or delays in return. Failure by the Participant to follow instructions voids any liability by the Organiser.

14. Waiver of Liability and Insurance

For certain activities, the Participant is required to sign a waiver of liability as a condition of participation. By signing, the Participant agrees not to hold One Blank Map sp. z o.o. (KRS number: 0001090186, NIP: 5252993730, REGON: 527883827), its employees, contractors, guides, managers, shareholders, or affiliates liable for any injuries, damages, losses, or fatalities that may occur in connection with participation in the activity or use of equipment. The waiver may also request disclosure of relevant medical information to determine suitability for participation.

The Organiser does not provide insurance coverage for Participants. The Participant is not insured by the Organiser. Each Participant is solely and fully responsible for obtaining, at their own expense and risk, all necessary insurance coverage in advance and prior to the start of the activity and/or the trip departure date. This includes, but is not limited to, health insurance, accident insurance, third-party coverage, property insurance, cancellation insurance, insurance covering extreme sports-related injuries, insurance covering full research and rescue operations, cycling, trekking, and/or any insurance applicable. The insurance must be suitable for the nature of the trip or activity and must take into account the Participant’s individual medical condition.

15. Equipment Marking and Seals

All equipment provided by the Organiser is marked and may be secured with special seals or identification tags for security and inventory purposes. The Participant is strictly prohibited from removing, tampering with, or attempting to alter these markings or seals. Any attempt to remove or damage the markings or seals may result in a fine, in addition to the cost of repair or replacement of the equipment, as determined by the Organiser.

16. Complaints

If the Participant experiences a problem or incurs damage during the activity, it must be reported immediately in writing to the activity leader or the Organiser to allow an attempt at on-site resolution. Acknowledgment of a complaint by staff does not constitute acceptance of liability.

If the issue is not resolved satisfactorily, a formal complaint must be submitted in writing to the Organiser’s booking office within four (4) weeks from the end date of the activity. The complaint should include documentation of the issue, including acknowledgment by the guide or staff, and any relevant evidence. Failure to report an issue during the activity or to submit a formal complaint within the specified period will result in forfeiture of the right to claim.

17. Photography and Promotion

During the activities, the Organiser’s staff may take photos or videos for marketing purposes. Participants who do not consent to the use of their image must inform the Organiser before the start of the activity.

18. Data Protection

Data protection provisions are outlined in the Privacy Policy available on the Organiser’s website.

19. Applicable Law and Jurisdiction

The contractual relationship is governed exclusively by Polish law. Any disputes shall be resolved by the court having jurisdiction over the registered office of the Organiser,

20. Severability Clause

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced with a valid provision that most closely reflects the original intent.

21. Amendments

The Organiser reserves the right to amend these Terms and Conditions at any time. The version valid at the time the contract is concluded shall apply.
